This application has been moved by Gram Panchayat of village Lohar Majra, Tehsil Pehowa, District Kurukshetra seeking modification/review of the order dated 04.11.2014. Vide that order, we had directed that since there is a Civil Court decree in favour of the writpetitioner to the effect that he shall not be dispossessed except in due course of law, the Collector, Kurukshetra and BDPO Thanesar would look into the matter and ensure that the Civil Court decree is not violated.

(2) The Gram Panchayat has now averred that the Civil Court decree was passed ex parte and an application to set aside the same has been filed by it. On this premise, modification of the order is sought. (3) In our considered view, once the application has been filed by the Gram Panchayat, it is imperative upon the Civil Court to decide that application expeditiously and in accordance with law uninfluenced of the order dated 04.11.2014 passed by this Court.

(4) With this clarification and direction, the application stands disposed of.
