(ORAL) The appellant/plaintiff is in appeal against the concurrent findings of the learned Courts below, whereby the suit for possession by way of specific performance of Agreement to Sell dated 03.12.2011 with permanent injunction filed by the appellant/plaintiff, has been dismissed by both the Courts below.

The present appeal pertains to the year 2018. Perusal of the order sheets shows that notice has not yet been issued in the same as the matter has been adjourned due to non-appearance of learned counsel for the appellant on 28.10.2024; and at request of learned counsel for the appellant on 04.04.2019, 17.01.2020, 09.10.2023, 29.02.2024 and 11.07.2024. Today also, none appeared on behalf of the appellant. Therefore, it can safely be presumed that the appellant or her counsel is not interested in pursuing the present appeal. In view of the above, the present appeal stands dismissed for non-prosecution.
