)*+ The instant petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, 'BNSS, 2023') seeking issuance of direction to the official respondents to constitute fresh medical board of five or more expert doctors as members with regard to head injuries of injured Mustakeem mentioned in MLR SRB/446/2022, Annexure P-2 dated 03.12.2022.

Learned counsel for the petitioner contends that he seeks direction to constitute a fresh medical board includng a Neurologist since there is a variation in the MLR as well as the opinion given by the Board. 3.

On the other hand, learned State counsel, appearing on advance notice, opposes the prayer made by learned counsel while submitting that SEEMA 2025.08.29 17:37 I attest to the accuracy and integrity of this document

 

  after the NCCT of the patient, the medical authority has constituted a board of three qualified doctors, so there is no need to constitute fresh medical board. The present petition is filed just to delay the proceedings. 4.

Heard.

In view of the submission made by learned State counsel which is not disputed by learned counsel for the petitioner, this Court is not inclined that opinion of the board of three doctors was taken after NCCT of patient.

Petition is dismissed being devoid of merits.
