Mr. Sukhwinder Singh Aviraj, Advocate, for the petitioner. ***** DEEPAK GUPTA, J. (ORAL) Petitioner is the mother of the child. She brought a petition (CIS No.GW-32-2023) under the provisions of the Guardian and Wards Act, 1890, seeking custody of the minor child against respondents, who are her husband and parents-in-law, pending before Family Court, Bathinda. Learned counsel for the petitioner contends that the petition was filed way back in April, 2023. All the three respondents were proceeded ex parte upto 04.12.2023. Petitioner produced ex parte evidence by examining 03 PWs and case was adjourned for remaining ex-parte evidence to 29.04.2024, when application to set aside the ex parte order was moved by the respondents and the same was allowed vide order dated 19.09.2024.

Learned counsel contends that respondents are intentionally delaying the proceedings despite the fact that matter pertains to the custody of the child. Simple prayer made by learned counsel is to direct the trial court concerned to expedite the disposal of the case. Without commenting on the merits of the case, this petition is disposed of with a direction to the concerned trial Court to take effective steps for expeditious disposal of the main petition, pending before it.
