The records show that the matter at hands is pending for quite some time and has not made any progress. Even on the previous date of hearing none had caused appearance on behalf of the parties and the matter was adjourned for today. The position is not any different as learned counsel for the petitioner prays for further adjournment. Though there is hardly any justification to defer the proceedings, but in the interest of justice the matter is adjourned to 10.05.2019.

Learned counsel for the petitioner submits that despite repeated telephonic communications to the petitioner to file counter affidavit to the written statement filed by the respondent and further instructions to pursue the matter, neither she nor anybody on her behalf has contacted his office. And, thus, in the situation let the petition be dismissed for non-prosecution.
