Prayer in this petition is for grant of anticipatory bail to the petitioner with permission to surrender before the trial Court, in FIR No.81 dated 18.04.2017 under Sections 379-B, 411 IPC, registered at Police Station

Learned counsel for the petitioner submits that vide order dated 07.09.2021 passed by this Court in CRM-M-36764-2021, the petitioner was granted the same relief, as he could not appear before the trial Court despite the fact that regular bail was granted on 12.05.2017. It is further submitted that a perusal of the previous orders would show that the case was fixed for prosecution evidence, when the petitioner was present, however, on account of non-appearance, bailable warrants were issued against the official witnesses, who were not appearing. It is also submitted that on 31.10.2022, the petitioner could not appear before the trial Court on account of noting a wrong date and even the counsel representing him could not appear. It is next submitted that the petitioner will surrender before the trial Court within a period of 10 days from today and will apply for fresh bail.

Notice of motion.

On asking of the Court, Mr. Navneet Singh, DAG, Punjab accepts notice on behalf of the respondent-State and submits that this is second time, when the petitioner absented from the Court proceedings. I have heard learned counsel for the parties. In view of the above, this petition is allowed and the petitioner is directed to appear before the trial Court within a period of 10 days from today and he will be released on bail subject to his furnishing fresh bail/surety bonds to the satisfaction of the trial Court/Illaqa Magistrate/Duty Magistrate,
