(") *+ Present petition has been filed under Section 482 of BNSS, 2023 for grant of anticipatory bail to the petitioner in FIR No.185 dated 06.07.2020, under Sections 307, 458, 447, 511, 148, 149, 188, 259, 353, 186 of IPC and 25/27/54/59 of Arms Act, under Section 3 of Epidemic Disease Act, under Section 51 of Disaster Management Act, 2005, registered at Police Station Beas, District Amritsar (Rural). Status report by way of affidavit of Arun Sharma, PPS, Deputy Superintendent of Police, Sub Division Baba Bakala Sahib, Amritsar (Rural), on behalf of respondent-State, filed in Court today is taken on record.
In compliance of order dated 19.08.2025, passed by the Coordinate Bench of this Court, affidavit of Gurpreet Singh Bhullar, IPS,
Commissioner of Police, Amritsar, on behalf of respondent-State, has been filed in Court today and the same is taken on record. It has been submitted in the said report that the list of all the relevant cases as ordered in the aforesaid order dated 19.08.2025 had been prepared category wise, as detailed in para No.6 of the affidavit. A comprehensive chart showing figures of all afore-mentioned categories had been prepared separately and annexed as Annexure A-1. The deponent issued directions to Senior Superintendent of Police, Amritsar Rural to initiate appropriate departmental action against all those erring police officials, whose case files are missing and the respective orders were accordingly passed by the Senior Superintendent of Police, Amritsar for initiating departmental enquiries against all respective police officials.
The Senior Superintendent of Police, Amritsar, submitted compliance report to the deponent vide his letter bearing No.31090/Reader dated 19.09.2025, thereby submitting that the reconstitution of missing files is under process and directions have been issued to get the absconding accused persons declared as proclaimed offenders/proclaimed persons who have not been arrested for more than 01 year and to move applications for attaching the movable and immovable properties of such accused and directions have also been issued to effect the arrest of smugglers at the earliest who have not been arrested for more than six months in NDPS Act cases.
Learned State counsel, on instructions, from DSP Dharminder Kalyan, has apprised the Court that in compliance of the order dated 20.08.2025 passed by this Court, the petitioner has joined the investigation and his further investigation is not required. In view of the afore-said submission made by learned State
counsel, the instant petition is allowed and the relief, as extended to the petitioner by this Court vide order dated 20.08.2025, is hereby made absolute.
However, the petitioner shall continue to join the investigation as and when required/called upon to do so and shall also strictly abide by all the conditions as laid down in Section 482(2) BNSS. !"#$"#!
