IN THE HIGH COURT OF PUNJAB & HARYANA, CHANDIGARH

VERSUS
State of Haryana & others ..... RESPONDENT(S)
CORAM:
HON'BLE MR. JUSTICE TRIBHUVAN DAHIYA PRESENT: - Mr. Ganesh Kumar Sharma, Advocate, for the petitioner. Mr. R.S. Budhwar, Additional Advocate General, Haryana.
Tribhuvan Dahiya, J (Oral) The petition has been filed, inter alia, seeking a writ of certiorari, setting aside the speaking order dated 20.02.2023, Annexure P-9, whereby the petitioner's application seeking family pension for his widowed daughter has been declined.
2.
Learned counsel for the petitioner contends that the petitioner is drawing two pensions; one from Uttar Haryana Bijli Vitran Nigam Limited (UHBVNL), and the other from the Department of Secondary Education. The request for entering the name of his widowed daughter, aged more than thirty years, as the one entitled to two family pension, has been wrongly rejected despite her entitlement for the same in terms of circular dated 01.01.2014.
3.
A perusal of the impugned order shows, the petitioner's request for granting family pension to his widowed daughter has been rejected since the said circular, dated 01.01.2014, stands superseded by the AVIN KUMAR 2024.07.11 11:07 I attest to the accuracy and integrity of this judgment/order.
CWP No.5457 of 2024 [2] Haryana Civil Services (Pension) Rules, 2016. Accordingly, reliance upon the circular to claim entitlement for family pension is without substance. 4.
No other argument has been raised.
4.
Dismissed.
