Kamninder Kaur v. State Of Haryana And ORS
121 RA-CW-254-2016 IN CWP-16156-2016 KAMNINDER KAUR VS STATE OF HARYANA AND ORS
Present:
Mr. Narender Pal Bhardwaj, Advocate, for the applicant/petitioner.
Notice of the application.
Mr. Harish Rathee, Senior Deputy Advocate General, Haryana, accepts notice.
This is a review application. Mr. Rathee had been given advance copy of the review application and has obtained instructions from the department and states that the school to which the applicant/petitioner has been transferred is at a distance of about ten kilometers from the previous school in District Kurukshetra. She has been serving in the previous school since 2003 and it is a rather long over stay. Even though the applicant/petitioner is to superannuate on 31.07.2017, the distance involved dissuades this Court to exercise its extra ordinary writ jurisdiction provided by Article 226 of the Constitution of India, which is meant to prevent injustice. No injustice has been done to the applicant/petitioner and, therefore, the complaint that the status quo order passed by me on 10.08.2016, was not complied with, since the applicant/petitioner had been relieved from the previous school a day before, is not sufficient ground neither to invite contempt nor to interfere in the matter.
Accordingly, the review application is dismissed. (RAJIV NARAIN RAINA) JUDGE September 15, 2016 Pkapoor Prashant Kapoor 2016.09.17 12:43 I attest to the accuracy and authenticity of this document
