The present petition has been filed seeking quashing of the impugned order dated 30.07.2024 passed by the Judicial Magistrate First Class, Sangrur in the complaint bearing NACT-225-2023 dated 20.02.2023 whereby the complaint under Section 138 of the NI Act was dismissed in default for want of prosecution.

After arguing the matter at some length and on being confronted with the fact that the effect of a dismissal in default would be acquittal and that in view of the judgment of the Supreme Court in the matter of M/s. Celestium Financial vs. A. Gnanasekaran Etc., 2025(3) RCR (Criminal) 208, he would have a remedy to prefer an appeal before the Court of Sessions Judge, Counsel for the petitioner seeks withdrawal of the instant petition so as to take alternative remedy available to the petitioner in accordance with law.
