SANDEEP MOUDGIL, J (ORAL) Prayer in the instant petition filed under Section 528 of BNSS is for issuance of directions to the respondents-State to investigate FIR No.10 dated 01.04.2024 under Sections 419,420,465,467,468,471,34 IPC registered at P.S NRI Amritsar and to arrest the accused/respondent No.5 as anticipatory bail application of respondent No.5 has been dismissed on 04.06.2024 (Annexure P-2) by Ld. Sessions Court and by this Court on 12.06.2024 (Annexure P-3). Today, a short reply has been filed by way of affidavit dated 21.10.2024 of Praveen Kumar Sinha, IPS, Additional Director General of Police, NRI Affairs Wing, Punjab, which is taken on record. A copy of the same has been furnished to learned counsel for the petitioner. Learned State counsel has referred to para 12 of the affidavit stating that all the accused in the instant FIR stand arrested and further investigation has infact commenced, which is being monitored by an officer of the rank of DSP as has been further deposed in para 9.

A perusal of para 9 would further make it evident that the MANOJ KUMAR 2024.10.22 21:45 I attest to the accuracy and authenticity of this order investigation of the case has now been assigned to Inspector Rajinder Kaur, SHO,

CRM-M-49104 of 2023 #2# P.S NRI Affairs, Amritsar by the Additional Inspector General of Police, NRI Affairs, Amritsar and DSP NRI Affairs, Amritsar has been directed to personally supervise the investigation of the case vide his office order dated 17.10.2024. In the wake of stand of learned State counsel, learned counsel for the petitioner having not been left with any other grievance do not press instant petition any further and seeks withdrawal of the same. Prayer is accepted.

Dismissed as withdrawn.
