(Oral) By way of the instant petition, petitioners have approached this Court for seeking a direction to the official respondents for protection of life and liberty of petitioners and their family members and not to implicate the petitioners and their family members in false cases at the mere instance of disclosure statement of any co-accused, who are in police custody. 2.

Learned counsel for the petitioner inter alia submits that there was a dispute regarding land of the petitioners No. 1 and 3 with the sarpanch of the village in the year 2012 and at that time one police official namely Karambir S/o Alok who is the resident of the same village was helping the sarpanch and in this regard firstly he tried to to implicate the petitioner no. 1 and 3 in some false cases and when he did not succeed then he falsely implicated the elder son namely Neeraj in a false case. It is further alleged that the police officials are harassing the petitioners and their family members and are demanding money/bribe and are threatening to kill the

- 2 - family members of the petitioners and also to implicate them in other criminal cases.

Learned State counsel has drawn the attention of this Court to Paragraphs No.4 to 8 of the status report dated 18/19.09.2023 that has been filed by the State, which are reproduced as under : "4.

That the son of the petitioner no.1 Mahesh Dutt is a hardcore criminal and as per the record the following cases stand registered against the petitioner Neeraj son of Mahesh Dutt :

That further it shall be pertinent to mention here that said Neeraj son of Mahesh Dutt has been categorized as most wanted criminal and a bounty of cash reward of Rs.25,000/- has been declared for him. That apart from that, the following cases stand registered against the petitioners Mahesh Dutt, Chand Ram and Vishnu Dutt: i.

FIR No.292 dated 18.07.2015 u/s 195A, 341, 506 & 34 IPC was registered against Chand Ram (Petitioner No.2) son of Mahesh Dutt. However, the accused was acquitted on 04.01.2017 in that case. ii.

FIR No.473 dated 25.06.2018 u/s Arms Act, PS, Sector 29, Gurugram is also pending in the Court of Ld. CJM, Gurugram on 11.10.2023, against Chand Ram (Petitioner No.2) iii.

FIR No.57/19 u/s 395, 397, 120B IPC and Arms Act PS, Palwal is pending against (petitioner) Chand Ram in the Court of Ld. ACJM, Palwal on 02.12.2023.

That apart from that, a criminal having emanated out of FIR No.292/12 u/s 454, 380 was also stand registered against Naresh son of Mahesh Chand.

That the following cases stand registered against Sourabh son of Dharam Chand, a family member of petitioners:- a.

FIR No.315/16 u/s 323, 452, 506, 34 IPC PS, Bhupani (acquitted on 25.04.2017).

FIR No.44/17 u/s 147, 149, 323, 506 and 452 IPC PS, Bhupani (acquitted 08.05.2023).

FIR No.294/17 u/s 147, 149, 323, 506 and 452 IPC PS,Bhupani (acquitted on 14.12.2017).

FIR No.358/17 u/s 148, 149, 307, 506 IPC PS, Bhupani (pending in the court of Ld. ASJ, Faridabad on 10.10.2023).

FIR No.161/19 Arms Act, PS Tigaon (Pending in the

FIR No.65/19 u/s 174A IPC, PS Bhupani (Convicted in the court of Ld. JMIC, Faridabad on 22.02.2021)" 4.

From a perusal of the record it is apparent that the petitioners are involved in various criminal cases that have been registered against them. The family of the petitioners have a checkered criminal history and there are several cases pending against them. Accordingly, this Court is of the considered opinion that there is no merit in the present petition and the same is dismissed. Pending application(s), if any, also stands disposed of accordingly.
