RAMENDRA JAIN, J. (ORAL) Through instant second petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to the petitioner in a case arising from FIR No.256 dated 03.07.2018 registered under Sections 365, 302, 201, 216, 34, 120-B IPC at Police Station Zirakpur. According to the prosecution, young boy Aditya was allured by petitioner and his accomplice to send him abroad by arranging a job for him. In lieu of their above service, they charged `80,000/- from Aditya. Instead of fulfilling their aforesaid promise, petitioner and his accomplice kidnapped the son of the complainant on 21.06.2018 inasmuch as Aditya could contact his father only in the evening of that day. Finally, Aditya was murdered.

Learned counsel for the petitioner inter alia contends that main accused in this case is Lakhbir Singh. Allegation against the petitioner is RAVINDER SINGH 2020.01.17 14:54 I attest to the accuracy and integrity of this document

-2CRM-M-46528 of 2019 that he helped the main accused Lakhbir Singh in disposal of dead body of Aditya. Petitioner is in custody since October, 2018. Conclusion of trial may take a sufficient long time. No useful purpose would be served by detaining the petitioner in jail any more.

On the other hand, learned State counsel vehemently opposed the grant of regular bail to the petitioner.

Considering overall facts and circumstances, petitioner does not deserve concession of regular bail inasmuch as he in connivance with co-accused has committed gruesome murder of a young boy on the false pretext of sending him abroad. Even otherwise, no new ground has been made out to grant him bail after dismissal of his first petition. Dismissed.
