Prayer in this petition under Section 438 CrPC is for grant of anticipatory bail in case FIR No.49 dated 31.08.2023 registered at Police Station, GRP Sangrur, Government Railway Police under Sections 332/353/186/34 IPC.

As per prosecution allegations, complainant Pardeep Kumar is posted as Constable in RPF. He was on duty at Beat No.1, 2, 3 Food Rack on 30.08.2023 and was patrolling the area at about 9.30 pm. He noticed four unidentified persons near railway cabin, sitting on the railway line towards Ganga Ram Basti. Performing his duty, complainant asked them to go away. However, one of such person, who was identified as Ajay Singh, felt enraged, picked up a stone from railway line and gave blow with that on the back side of the head of the complainant. Other three persons accompanying him picked up sticks and stones and caused injuries to him. Feeling frightened, complainant stepped back. In the meantime, HC Jasvir Singh and HC Krishan Lala staff members of the complainant reached there and the assailants fled away. CRM-M-51198-2023 2023:PHHC:131760 Sangrur, where his MLR was prepared. On the statement of complainant Pardeep Kumar, FIR was registered. During investigation, Ajay Singh was arrested and on interrogation, he disclosed the names of other assailants as Anmol Singh @ Tidda s/o Raju, Ajay s/o Kuldeep Singh, Laddi son of Mandal.

Contention of ld. counsel is that petitioner has been falsely implicated; that he is not named in the FIR and that petitioner had some dispute with co-accused Ajay Singh against whom the mother of the petitioner had even given a representation to the SSP, Sangrur. 4.
However, on raising query by this Court, ld. counsel for the petitioner conceded that representation (Annexure P2) is undated and without any dispatch number. Said representation (Annexure P2) appears to have been concocted.

Ajay Singh was specifically named as one of the assailants and was arrested. Petitioner has been nominated to be one of the assailants. 6.
After hearing ld. counsel for the petitioner and going through the paper-book, this Court does not find the present case to be fit for grant of anticipatory bail.
Dismissed.
