Prayer in the present petition filed under Section 439 Cr.P.C. is for grant of regular bail to the petitioner in case FIR No.0433 dated 24.07.2022 registered under Sections 34, 379-B IPC (Sections 392, 397, 201 IPC added later on) at Police Station Gannaur, District Sonipat. 2.

Custody certificate filed by learned State counsel is taken on record, as per which, the petitioner is behind bars for 1 month and 14 days.

Learned State counsel submits that the petitioner having been convicted in 2 cases, in one on 14.03.2023 and another on 21.09.2023 but the said fact has not been disclosed in the present petition which was filed on 04.10.2023.

Learned counsel for the petitioner prays for withdrawal of the present petition.
