**** HARSIMRAN SINGH SETHI, J. (Oral) Learned counsel for the appellant submits that the pensionary benefits of the appellant were withheld on the ground that he was convicted in FIR No. 2 dated 05.01.2006 under Sections 7, 8, 9, 10, 12 and 13 of the Prevention of Corruption Act, 1988 and Section 120-B IPC, registered at Policy Station Nishing, District Karnal.
Learned counsel for the appellant submits that the appeal against the said FIR is still pending, hence, the present regular second appeal and application for condonation of delay may kindly be disposed of having been not pressed any further with liberty to the appellant to avail appropriate remedy with regard to agitate the claim of pension after the decision of the said appeal, in case the same survives.
Ordered accordingly.
