**** RAJ MOHAN SINGH, J.(Oral) Petitioner has preferred this writ petition for the issuance of an appropriate writ, order or direction in the nature of mandamus directing the official respondents to initiate legal proceedings on the representation moved by the petitioner and also to protect life and liberty of the petitioner from being invaded by private respondents No.4 to 13.
On 09.12.2019, learned State counsel sought time to get instructions as to what action, if any, taken upon the complaint filed by the petitioner on 22.03.2019. On 16.01.2020, learned State counsel on instructions
from ASI Sukhram Singh, Police Station Mehtiana submitted that the complaint filed by the petitioner was looked into and was filed by the competent authority.
In pursuance of the aforesaid order, an affidavit has been filed by Gurpreet Singh, PPS, Deputy Superintendent of Police, Sub-Division Hoshiarpur along with the copy of inquiry report.
According to the affidavit attached with the inquiry report, it can be noticed that the complaint filed by the petitioner was duly inquired into by recording statements of respectable persons of the village. There is a religious place of Baba Yosuf Shah Chisti in the village and there is also a landed property measuring 14-15 marlas falling within lal dora of the village. Petitioner started raising claim over the said property. The Panchayat of the village submitted an application to the BDPO, Hoshiarpur, vide letter dated 14.03.2019 restraining the petitioner from taking possession over the panchayat property. The report further reveals that petitioner without any permission of the Gram Panchayat started raising boundary wall over the property in question. At this respectables of the village stopped the petitioner from doing such act and there was a quarrel between both the factions. The village Panchayat submitted an application to the Police and during inquiry it was found that nobody had suffered any injury in the said quarrel and only
clothes of some persons were torn. Petitioner could not produce any evidence to substantiate any such injury warranting any action by the Police.
In view of aforesaid status report filed by the DSP, Hoshiarpur, no further action is called for. This petition is disposed of with. However, liberty is granted to the petitioner that in case, if any, grievance subsists, he may avail his legal remedy in accordance with law.
