***** ARCHANA PURI, J. (Oral) At this stage, counsel for the respondent has given a statement that the respondent has no objection, if the transfer application is accepted and the divorce petition is transferred from Family Court, Jind, to the Court of competent jurisdiction at Panipat.
In view of the statement aforesaid, it is pertinent to mention that, as evident from the contents of the application, the respondent is facing trial in the Courts at Panipat, relating to FIR bearing No.817 dated 08.12.2021, under Sections 313, 323, 34, 406, 498-A and 506 IPC, got lodged by the applicant at Police Station Panipat City. Also, he is making appearance in the Courts at Panipat, in two other cases, arising from the matrimonial dispute i.e. the petition under Section 125 Cr.P.C., as well as the petition under Section 25 of the Guardians and Wards Act. TA-1056-2025 Considering the statement made by the counsel for the respondent, as well as taking into consideration the fact about the respondent already making appearance in three other litigations, which are pending at Panipat, more particularly, the criminal case, wherein he is required to make appearance on each and every date of hearing, the transfer application is allowed and the petition under Section 13 of the Hindu Marriage Act i.e. HMA/334/2024, titled 'Anil Vs. Jyoti', filed by the respondent-husband, stands transferred from the Family Court, Jind, to the Court of competent jurisdiction at Panipat. The requisite record of the aforesaid case be sent by the Family Court, Jind, to the District and Sessions Judge, Panipat. Learned District and Sessions Judge, Panipat, shall assign the said petition to the Family Court, Panipat. Even, the parties are directed to appear before the Family Court, Panipat, within a period of one month from today onwards.
