IN THE HIGH COURT OF PUNJAB AND HARYANA

AT CHANDIGARH RSA-5799-2017 (O&M) Date of decision : 18.01.2019 Bachittar Singh ... Appellant

Versus

Gurmeet Singh and others ... Respondents

CORAM:

HON'BLE MR. JUSTICE AMIT RAWAL

Present:

Mr. Balbir Singh Jaswal, Advocate for the appellant. **** AMIT RAWAL, J. (ORAL) CM-5799-C-2017 For the reasons stated in the application, the delay of 64 days in refiling the appeal is condoned.

CM stands disposed of.

RSA-5799-2017 The short point involved in the present regular second appeal is whether relief sought in the plaint could have been granted without availing the statutory remedy under the Specific Relief Act or not. The answer is 'No'. This is what has been noticed by the Courts below. In this view of the matter, I do not find any illegality and perversity in the judgments and decrees of the Courts below, much less, no substantial question of law arises for determination. No ground for interference is made out.

Resultantly, the present regular second appeal is dismissed. 18.01.2019 Yogesh Sharma ( AMIT RAWAL ) JUDGE Whether speaking/reasoned Yes/ No Whether Reportable Yes/ No
