The lackadaisical and indolent approach of the respondents in deciding the petitioner's legal notice (Annexure P-6), wherein became enclosed request to determine and pay full pension, has propelled the petitioner to institute the instant writ petition seeking issuance of apposite directions upon the respondents.

The learned counsel for the petitioner submits that the Government has already taken a policy decision to the effect that a pension equal to 50% of the emoluments, or of the average emoluments received during the last 10 months, shall be admissible to those employees who have rendered a minimum qualifying service of 25 years. Therefore, since the petitioner has rendered more than 25 years but less than 33 years of service, he is entitled to full pension. 3.

CWP-24244-2025 notice and represents the respondents, submits that he has no objection, in case, a direction is passed upon the respondents No.2 and 3 to take a final decision upon the petitioner's legal notice (Annexure P-6) in a time bound manner.

In view of the above, this Court deems it appropriate to pass a direction upon the respondents No.2 and 3 to take a final decision upon the petitioner's legal notice (Annexure P-6) within six weeks from the date of receipt of a certified copy of this order. 5.

Disposed of accordingly.
