SUBHAS MEHLA ( & )*+ The instant petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, 'BNSS, 2023') seeking issuance of a direction to the official respondents to register a criminal case against respondents no. 4 and 5 for committing cognizable offences and for conducting a fair, proper and impartial investigation against the said respondents.

Learned counsel for the petitioner contends that respondents no. 4 and 5 have cheated the petitioner and the petitioner moved a representation to the higher authorities regarding the fraud committed upon him but no action has been taken so far.

Mr. Karan Veer Singh, Sr. Deputy Advocate General, Haryana accepts notice on behalf of the official respondents and apprised the Court SEEMA 2025.08.27 18:53 I attest to the accuracy and integrity of this document

   that on the complaint of the petitioner, both the parties were called and the matter was looked into but no offence was made out. He further contended that on the complaint of the respondents even an FIR has been registered against the petitioner and the present case is nothing but a counter-blast to the said FIR.

In view of above and the fact that the petitioner has not approached this Court with clean hands, this Court is not inclined to entertain the present petition.

Petition is dismissed being devoid of merits.
