On 10.10.2023 the following order was passed : "The petitioner has approached this Court through the instant Revision Petition filed under Article 227 of the Constitution of India for setting aside the order dated 30.08.2023 passed by the court of learned Addl. Civil Judge (Sr. Divn.), Jalandhar, whereby the trial court has issued sale warrant of the property in question, which has been put on auction for 11.10.2023.

Learned counsel for the petitioner inter alia submits that the petitioner is ready to pay the due amount in terms of the judgement and decree dated 22.03.2016 (Annexure P2) passed by the court of learned Civil Judge (Sr. Divn.), S.B.S. Nagar. He seeks an adjournment to bring the decreed amount in the shape of a bank draft in the name of the respondent on the next date of hearing. Adjourned to 17.10.2023."

Thereafter, repeatedly, the case has been adjourned on the request of the learned counsel for the petitioner to comply with the order dated 10.10.2023. Even today the learned counsel for the petitioner states that there has been no compliance of the order dated 10.10.2023 and that the petitioner is not responding to his phone calls. In view thereof, this Court is left with no other option but to dismiss the present petition for non-prosecution.

Dismissed for non-prosecution. Pending applications, if any, also stand disposed off.
