(ORAL) This is a petition that has been filed under Section 439 Cr.P.C for grant of regular bail in case FIR No.53 dated 30.07.2019 registered under Sections 363, 366-A, 120-B IPC (Sections 187 IPC, 376 IPC and Sections 3/4 of POCSO Act, 2012 added later on) at Police Station Sadiq, District Faridkot.

Learned counsel for the petitioner would submit that the petitioner has been falsely implicated in the present case and is behind the bars since 30.07.2019 whereas a co-accused namely Jarnail Singh, who approached this Court by way of CRM-M No.40135 of 2019, has already been granted bail by this Court on 30.09.2019. The trial is likely to take some time to conclude and therefore, prays for release of the petitioner on bail.

Per contra, learned counsel appearing on behalf of the respondent-State opposes the bail application, while contending that the offences alleged against the petitioner are serious in nature and therefore, PANKAJ KUMAR 2020.02.11 16:02 I attest to the accuracy and integrity of this document

CRM-M No.46206 of 2019 -2the petitioner is not entitled to concession of regular bail. I have heard learned counsel for the parties. Keeping in view the fact that petitioner is in custody for a considerable length of time and a co-accused namely Jarnail Singh has already been granted regular bail by this Court vide order dated 30.09.2019, no useful purpose would be served in keeping the petitioner behind the bars. The instant petition is allowed and the petitioner is directed to be released on regular bail on execution of adequate personal bond and surety bond to the satisfaction of concerned trial Court/Duty Magistrate. However, any observation made herein shall not be construed to be an opinion on merits of the case.
