Through the instant writ petition, a prayer has been made for setting aside the order dated 06.08.2025 (Annexure P-7), whereby respondent No. 2, on account of violation of the rules governing government accommodation, cancelled the petitioner's allotment of the government house and directed him to vacate the same. 2.

The bedrock for drawing the impugned order is that, the petitioner has been keeping a ferocious dog in the government house allotted to him.

At the outset, the learned counsel for the petitioner, without entering into the issue of legality of the impugned order, submits that the petitioner has already shifted his ferocious dog from the government house to a different place. He is also ready to swear an affidavit before the Deputy Commissioner, Hisar, to the effect that, in future, he will not keep DEVINDER YADAV 2025.09.01 09:24 I attest to the accuracy and authenticity of this order/judgment

CWP-24219-2025 any ferocious dog in the government house, in violation of the rules governing government accommodation.

The learned State counsel submits that, in view of the specific averment made by the learned counsel for the petitioner, in case the petitioner swears the affidavit (supra), the Deputy Commissioner, Hisar, shall consider the entire issue afresh. 5.

Since the petitioner has already taken corrective measures by shifting his ferocious dog to a different place, and is also ready to swear an affidavit in this regard, the very basis of the impugned order does not survive. Consequently, the impugned order is set aside. The petitioner is directed to furnish, within seven working days from today, an affidavit before the Deputy Commissioner, Hisar, undertaking that he has shifted his ferocious dog from the government house to a different place, and he will not keep any ferocious dog in the government house in future, and he will abide by the rules governing government accommodation. Thereafter, the Deputy Commissioner, Hisar, shall re-examine the entire issue afresh. 6.

Disposed of accordingly.
