This is an application seeking review of an order dated 19.8.2014 whereby writ petition preferred by the petitioner was dismissed. On a Letters Patent Appeal being preferred by him, petitioner has been given liberty to move appropriate application to explain about the quality of land which fell to his share. Learned State counsel was asked to assist this court on the last date of hearing. According to him, scope of the application is only limited as regards quality of land. He, however, prays that there is nothing to show that petitioner has been given land is of inferior quality. Counsel for the applicant/petitioner has referred to site plan (Annexure P12) and submits that there are chunks of land which are either Nehri, Chahi or Barani. According to him, more land of Barani nature, has been given to him.

Review Application No. 616-CWP of 2014 In Civil Writ Petition No. 16434 of 2014 I am not convinced with this plea. The land shown in yellow colour in the site plan infact abuts the main road. It is, therefore, inexplicable how injustice has been caused to the petitioner. I find no ground to re-open the partition proceedings.

Application, is thus, without any merit and is hereby dismissed. (Rajan Gupta) Judge January 6, 2015 "DK"
