The present regular second appeal pertains to the year 2018 and the same is still at the stage of preliminary hearing inasmuch as notice of motion is yet to be issued. The case has repeatedly been adjourned on the request of the learned counsel for the appellant on one ground or the other. On 29.08.2024 it was made clear that no further adjournment shall be granted on any account and in case the matter was not argued on the date fixed, the same shall be dismissed for non-prosecution. However, yet again on 27.01.2025 a written request for an adjournment was circulated on behalf of the learned counsel for the appellant on the ground that he was in personal difficulty. 2.

Today, again a request for an adjournment is made on behalf of the arguing counsel for the appellant on the ground that he has gone to the Hon'ble Supreme Court for a matter though no adjournment slip is filed in AMAN JAIN 2025.08.27 09:19 I attest to the accuracy and integrity of this order/judgment

RSA-5597-2018 (O&M) -2this regard. It appears that the appellant is not interested in pursuing the present regular second appeal.

In view thereof, this Court is left with no other option but to dismiss the present regular second appeal for non-prosecution. 4.

Dismissed for non-prosecution. Pending applications, if any, also stand disposed off.
