(Oral) (1) This application seeks to review/recall the order dated 12.08.2014 whereby the Letters Patent Appeal was dismissed. Learned Single Judge had also rejected the appellant's claim to restrain the respondent-authorities from interfering in the milling of paddy by his rice mill or that he may be permitted to deposit the sale proceeds in the Bank towards loan account. Such a relief was declined on the basis of prima facie finding of fact that the appellant had failed to account for 1,78,470 bags of paddy entrusted to him for milling.
(2) The review application is now supported with some information received under the RTI Act and based thereupon, it is contended that the facts are hardly in dispute and that entrustment of 222954 bags of paddy to the appellant was not proved. (3) In our considered view, the review application is nothing but an attempt to re-argue the case on merit. The information taken under the RTI Act is selective. No case to review/recall the order dated 12.08.2014 is made out.

CM-1447-LPA-2015 For the reasons mentioned in the application, the same is allowed and the delay of 235 days in filing the review application is condoned.
