SANDEEP MOUDGIL, J (ORAL) The jurisdiction of this Court has been invoked under Section 483 BNSS seeking interim regular bail in case FIR No.02 dated 07.01.2025 under Section 22C of NDPS Act (later on added Section 29 of NDPS Act) registered at P.S Sadar Jalalabad, Districvt Fazilka.

In compliance of order dated 21.08.2025, learned State counsel has filed Medical status report by way of short affidavit of Officiating Superintendent, Central Jail, Faridkot which states that initially he was presented to Jail Hospital OPD on 25.07.2025 with complaints of Cough with expectoration and hemoptysis wherein he was advised blood investigations, sputum for AFB & CBNAAT and oral medications. Thereafter, he was again presented to Jail Hospital OPD on 28.07.2025 with similar complaints and was admitted in IPD for treatment. He was referred to Civil Hospital Faridkot on 29.07.2025 and thereafter he was referred to GGS Medical College & Hospital Faridkot on 30.07.2025 where he MANOJ KUMAR 2025.08.24 00:35 I attest to the accuracy and authenticity of this order

CRM-M- 45433-2025 was admitted and was diagnosed with pulmonary TB (NC) with hemoptysis (recovered) with hepatitis (recovered).

The fact remains that the petitioner is under treatment though he was later discharged on 01.08.2025. Thereafter he was kept in Isolation Ward at Jail Hospital Faridkot and is undergoing treatment as advised by the Doctors of GGS Medical College & Hospital Faridkot. The nature of ailment is of such critical nature that he requires special care and attention including special diet which may not be feasible in the prevailing circumstances. In these circumstances, the present petition is allowed and the petitioner is directed to be enlarged on interim bail for a period of 04 weeks commencing from tomorrow i.e 23.08.2025 subject to his furnishing bail bonds and surety bonds to the satisfaction of the trial Court/Duty Magistrate concerned.

It is however made clear that the petitioner at the time of surrendering before the Jail Authorities, he shall put on record the medical record and all the history of his checks up for the sole purpose for which he is being admitted to interim bail. In case of failure, an inference would be drawn against the petitioner and during the interregnum period, respondents-State would be at liberty to move appropriate application seeking cancellation of this relief. It is further directed that the petitioner shall surrender on 20.09.2025 at 5.00 p.m before the concerned jail Authorities.
