Petitioner has filed instant petition under Section 482 of BNSS, 2023 for grant of anticipatory bail in FIR No.76 dated 22.07.2024 under Sections 21 and 29 of NDPS Act, registered at Police Station Fatehgarh Churian, District Batala, District Gurdaspur, Punjab. 2.
Learned counsel for petitioner argued that arrest of petitioner was stayed vide order 27.09.2024 which runs as under:- "Petitioner - Pardeep Singh has filed instant petition under Section 482 of BNSS, 2023 for grant of anticipatory bail in FIR No.76 dated 22.07.2024 under Sections 21 and 29 of NDPS Act registered at Police Station Fatehgarh Churian, Police District Batala, District Gurdaspur, Punjab (Annexure P1). Learned counsel for petitioner submits that name of petitioner has been nominated on the disclosure statement of coaccused Gurpreet Singh @ Hira from whom recovery of 9 grams of heroin has been recovered whereas it is the case of no recovery from the present petitioner. Notice of motion.

On asking of this Court, Mr. Kewal Singh, Addl. A.G. Punjabaccepts notice on behalf of State. He seeks an adjournment to file status report. Adjourned to 26.11.2024. In the meantime, arrest of petitioner is stayed subject to joining of his investigation." 3.
He further argued that in compliance to the aforesaid order, he has already joined the investigation and fully cooperated. No recovery is to be effected from him. He was nominated on the statement of co-accused Gurpreet Singh @ Hira, from whose possession 9 grams of heroin was recovered. Therefore, his anticipatory bail may be allowed. 4.
Status report is filed in which it is confirmed that petitioner has joined investigation on 01.10.2024.

Since petitioner has already joined the investigation, therefore, he is not required for any other purpose. Recovery has already been effected from co-accused. He is still ready to abide by the terms and conditions of bail order. Considering the aforesaid factual position, anticipatory bail application filed by petitioner is allowed subject to condition that petitioner will join investigation as and when required. He will not tamper with or interfere with investigation and will not leave the country without prior permission as provided under Section 482 (2) of BNSS, 2023.
