(Oral) On 02.12.2022, the following order was passed: "Learned counsel for the petitioner would submit that the petitioner is ready to return Scorpio Car which is bone of dispute.
Learned counsel for the complainant submits that the car has already been used for about 02 years and if further sold, it would fetch not more than 50% of the value at which car was sold to the petitioner.
Learned counsel for the petitioner submits that he is ready to pay differential amount if car is sold to 3rd party.
The petitioner is directed to hand over car to complainant within 24 hours from today.
The complainant would be at liberty to sell the car and petitioner shall pay differential amount i.e. the difference between the price at which he had initially purchased and the price at which car is sold to 3rd party. Adjourned to 20.12.2022.
Meantime, arrest of the petitioner shall remain stayed."

CRM-M-54212-2022 -2Learned counsel for the petitioner concedes that petitioner till date has not handed over Scorpio car in question to the complainant.
The petitioner, inspite of direction of this Court, has not handed over car to the complainant. The petitioner has no regard for the orders of this court. This shows conduct of the petitioner. The petitioner does not deserve any leniency and accordingly present petition is dismissed.
