On November 25, 2019, the following order had been passed by this Court:- "Upon notice of motion having been issued, learned State counsel on instructions from the police official who is present in court to assist him, submits that as a matter of fact even on 15.05.2018, when the date for execution of the sale deed had been extended by the petitioner and the complainant to 15.06.2018, the petitioner and her co-accused (her son) accepted Rs.4.5 lacs, after which they did not turn up before the Registrar on June 15, 2018 to get the sale deed registered, whereas the complainant had duly got his presence marked. Cr. Misc. No.M-46544 of 2019 [2] In view of the above, though Mr. Kambojs' contention on the last date was that no civil suit has been filed by the complainant seeking specific performance of the agreement, yet, the contention of the petitioner that it was the complainant who was not willing to pay the money, would be difficult to believe.

Mr. Kamboj seeks time to take instructions as to whether the petitioner would be willing to return the money to the complainant or not.

For that purpose, adjourned to 28.11.2019.

Interim order to continue till the next date of hearing." Today, learned counsel for the petitioner submits that he may be permitted to withdraw this petition.

Dismissed as withdrawn.
