The petitioner seeks issuance of a writ in the nature of mandamus so as to direct the respondents to grant/release the entire ex-gratia benefit in compliance of instructions dated 29.10.2021 (Annexure P-4) as well as complete service/retiral benefits including gratuity benefits etc. as husband of the petitioner suffered homicidal death while performing his duty. 2.

Learned counsel for the petitioner submitted that husband of the petitioner, who was working as 'Beldar' under Water Supply Scheme at Tharajwala, Sri Muktsar Sahib, was attacked by the villagers, where he was posted, leading to his death. It has been submitted that as per instructions/policy of Government of Punjab, his widow was required to be given ex - gratia grant to the tune of Rs.10 lakhs, whereas the respondents have sanctioned a grant to the tune of Pankaj Kakkar 2023.10.17 10:19 I attest to the accuracy and authenticity of this document

Learned counsel, in this regard, has drawn the attention of this Court to instructions/policy dated 29.10.2021 (Annexure P-4) of Government of Punjab. It has been submitted that although the petitioner had submitted a representation dated 11.9.2023 (Annexure P-7) to the department concerned, but to no avail.

On asking of the Court, Mr. Inderpreet Singh Kang, AAG, Punjab., upon whom an advance copy of petition had already been served, accepts notice on behalf of the respondent-State.

Having heard learned counsel for the petitioner and bearing in mind the nature of issue involved herein and also the nature of order, this Court intends to pass, it is not deemed necessary to call for any response from the respondent - State at this stage. The instant petition, as such, is disposed of with a direction to the respondent No.3 - Chief Engineer, Department of Water Supplies and Sanitation, Phase 2, 166, Mohali to get the representation dated 11.9.2023 (Annexure P-7) examined, so that the same is disposed of in accordance with law expeditiously.
