Present petition has been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of regular bail to the petitioner in case FIR No.335 dated 23.12.2023 under Sections 302, 392 of the IPC and Section 25(1-B)(a) of Arms Act, 1959, registered at Police Station Manesar, District Gurugram. 2.

Faced with the situation that a prime private prosecution witness PW Vinod is yet to be examined as a witness, learned counsel for the petitioner seeks to withdraw the petition in hand at this stage. 3.

Ordered accordingly.

Since the petitioner is in custody for a period of more than 2 years, it is deemed appropriate that the testimony of the said PW Vinod be recorded at the earliest by the trial Court.
