Dilbagh Singh v. Bir Singh & ORS
IN THE HIGH COURT FOR THE STATES OF PUNJAB AND
HARYANA AT CHANDIGARH RSA No.629 of 2017 (O&M) Date of Decision.14.11.2018 Dilbagh Singh ...Appellant Vs Bir Singh and others
...Respondents
CORAM:HON'BLE MR. JUSTICE AMIT RAWAL
Present:
Mr. Kanwal Goyal, Advocate for the appellant.
-.- AMIT RAWAL J. (ORAL) The only grievance expressed at the behest of the appellant-defendant No.1 is that the lower Appellate Court while granting injunction in favour of the respondent No.1-plaintiff qua forcible interference and dispossession except in due course of law, observed that respondent-plaintiff is owner of 8 1⁄2 marlas but the description in the site plan is not correct.
I am of the view that in case there is error apparent on the face of record, plaintiff has remedy to seek review of the order. At this stage, learned counsel for the appellant seeks liberty of this Court to withdraw the appeal by filing an application for review.
Ordered accordingly.
In case such application is filed, the Court shall decide the same in accordance with law.
