The instant petition has been filed for initiation of contempt proceedings against the respondents for intentionally and willfully disobeying the directions passed by this Court vide order dated 05.07.2023 (Annexure P-1), in CWP-13982-2023.

As per the order dated 05.07.2023 (Annexure P-1), respondent No.3-Executive Officer, Municipal Council, Sunam, District Sangrur, was directed to consider the Legal Notice dated 01.08.2022 and pass a reasoned and speaking order within a period of 03 months. It was further observed that if any amount is found due and payable to the petitioner, the same shall be disbursed in its favour within a period of 03 months. 3.
Today, learned counsel for respondent No.3 has filed reply/compliance report dated 18.08.2025 on behalf of respondent No.3-
Executive Officer, Municipal Council, Sunam, District, Sangrur, which is taken on record.

Learned counsel for the petitioner submits that he has already received an advance copy of the compliance report. 5.
I have heard learned counsel for the parties and perused the paper book as well as the reply/compliance report filed on behalf of respondent No.3.

A speaking order dated 05.10.2023 (Annexure R-3/1/T) has been passed by respondent No.3-Executive Officer, Municipal Council, Sunam, in compliance of the order dated 05.07.2023 (Annexure P-1). Apart from this, as per the reply, respondent No.3 has determined the payment, which is due towards the petitioner, out of which, some amount has already been paid to the petitioner. However, regarding the remaining payment, respondent No.3 has taken a plea that till the receipt of the advance/loan from the Government, payment to the tune of Rs.5,00,000/- shall be made to the petitioner every month, on priority basis, from the funds of the Municipal Council, Sunam.

Learned counsel for the petitioner submits that the petitioner is entitled to receive the entire payment within a period of 03 months, as per the order dated 05.07.2023 (Annexure P-1).

Learned counsel for respondent No.3 admits that the payment has not been made in a time-bound manner. However, he submits that respondent No.3 shall consider the claim of the petitioner for making the additional payment of interest on account of delay in making the remaining payment, which has been found due, as per the Speaking Order.

In view of the aforesaid undertaking given by learned counsel for respondent No.3, which has been accepted by learned counsel for the petitioner, the present petition stands disposed of as having been rendered infructuous.

Needless to say, the respondent shall continue making the payment in view of the undertaking given by him in the reply/compliance report. The representation given by the petitioner within a period of 02 weeks, if any, shall be decided by respondent No.3 within a period of 04 weeks thereafter.

However, liberty is granted to the petitioner to file an application for revival of the present petition, in case he has any grievance. 12.
Pending miscellaneous applications, if any, shall stand disposed of.
