WALIA, J (ORAL) On 17.02.2018, learned counsel for the appellant had contended that the appellant had been ready for out of court settlement whereupon notice of motion was issued for 30.5.2018 only to the extent of mediation. As per office report submitted for 30.5.2018, notices could not be issued as learned counsel had not furnished the process fee. Even as on date, the position remains the same.

It appears that the appellant is no longer interested in prosecuting the case.

Dismissed in default.
