(ORAL) The short point involved in the present appeal is whether the plaintiffs could succeed in claiming possession of the suit property while denying alleged exchange deed on behalf of their father, the answer would be 'no', as factum of registered exchange deed dated 16.02.1957 was not disclosed in the plaint and came to light in the defence of defendants. Plaintiffs failed to belie aforementioned document.

In such circumstances, dismissal of the suit was inevitable. I do not find any illegality and perversity in the concurrent finding of fact, much less, no substantial question of law arises for determination by this Court. No ground for interference is made out. Resultantly, the second appeal is dismissed.
