5 "On the oral request of learned counsel for the petitioner, complainant-Pxxx is impleaded as respondent No.2 in the array of parties. Let amended memo of parties be filed in the registry within three working days positively.

Apprehending his arrest in case FIR No.170 dated 13.07.2025 registered under Section 75 of the Bharatiya Nyaya Sanhita, 2023 at Police Station City Gurdaspur, District Gurdaspur, petitioner has filed the instant petition under Section 482 Bharatiya Nagarik Suraksha Sanhita, 2023 seeking pre-arrest bail.

Learned counsel for the petitioner inter alia submits that the petitioner, who is 61 years of age, is innocent and has been falsely implicated in the present FIR, which is an outburst of the directions issued by the District Consumer Disputes Redressal Forum, Gurdaspur, dated 24.09.2018 whereby father of the complainant was directed to pay a sum HARPREET SINGH CHAUHAN 2025.12.12 13:27 I agree to specified portions of this document

 



of Rs.4,03,515/- and 6930/- Ringgit Malaysian currency which is being paid in instalments. He further submits that co-accused-Tarsem Singh has been granted ad interim anticipatory bail by this Court vide order dated 13.08.2025, passed in CRM-M-44131 of 2025 (Tarsem Singh v. State of Punjab and another). He further submits that the petitioner is not involved in any other case and is ready and willing to join the investigation. Notice of motion.

Mr. Adhiraj Singh, AAG, Punjab, accepts notice on behalf of respondent No.1-State and seeks time to file status report. Let notice be served upon respondent No.2, returnable on 13.11.2025.

In the meanwhile, arrest of the petitioner shall remain stayed. He shall join the investigation and co-operate with the investigating agency and shall not leave the country without prior permission of the Court. To be heard along with CRM-M-44131 of 2025."
