(ORAL) Prayer in the writ petition is for issuing direction to respondents to grant deemed date of appointment to the petitioners as that has been given to other similarly situated employees vide order dated 13.03.2016 (Annexure P-1) with all consequential benefits in pursuance of same selection process conducted by Haryana Staff Selection Commission and further grant the benefit of seniority and notional pay fixation w.e.f. 12.04.1990 with all consequential benefits and actual benefit from the date of joining at par with similarly situated employees and release arrears of pay after re-fixation of pay.
As per averments in writ petition, petitioners have already made a legal representation dated 15.03.2019 (Annexure P-3) to respondent No.2 but no action has been taken so far.
Without going into the merits and demerits of the claim of the petitioners, I deem it appropriate to direct respondent No.2-Director General Higher Education, Haryana, Plot No.1B, Shiksha Sadan, Sector 5, Panchkula to consider the legal representation dated 15.03.2019 (Annexure PANKAJ KUMAR 2019.11.08 18:15 I attest to the accuracy and integrity of this document
CWP No.31863 of 2019 (O&M) -2P-3) within a period of two months from the date of receipt of certified copy of this order and pass a speaking order thereon, failing which respondent No.2 shall be liable to pay costs of `25,000/- to the petitioners. This condition of imposing costs is only to prevent petitioners running from pillar to post and avail remedy of contempt in case of non-compliance of directions issued by this Court.
