Present appeal is directed against the order passed by Principal Judge Family court, Kurukshetra whereby petition of petitioner no. 1 has been ordered to be dismissed as withdrawn. It appears that a joint petition under section 13-B of the Hindu Marriage Act, 1955 was presented before the court for dissolution of marriage. Both parties deposed at the first motion. At the stage of second motion, however, petitioner no. 1 namely Doli stated that she did not want to get divorce from petitioner no. 2. As such, she withdrew her consent. In such a circumstance, trial court was left with no option but to dismiss the petition as withdrawn. We find no reason to interfere in appellate jurisdiction. Dismissed.
