Apprehending his arrest in FIR No.24 dated 10.04.2022, registered for offences punishable under Sections 420, 120-B of the Indian Penal Code, 1860, Section 13 of Punjab Prevention of Human Smuggling Act, 2012 and Section 13 of Punjab Travel Professionals (Regulation) Act, 2014 at Police Station Bhanik Mian Khan, District Gurdaspur, the petitioner has preferred this petition under Section 438 Cr.P.C. seeking pre-arrest bail. Ld. Counsel for the petitioner submits that even if the allegations are taken on their face value it is only an amount of Rs.1,53,000/- that has travelled to the account of the petitioner and the petitioner in order to show his bona fide is ready to pay back the same.

Issue notice of motion, returnable for 15.04.2024. Mr. Tarun Aggarwal, Sr. DAG, Punjab appears and accepts notice on behalf of the respondent/State.

In the meantime, in the event of arrest, the petitioner shall be released on interim bail subject to his furnishing personal and surety bonds to the satisfaction of the Arresting Officer/Investigating Officer. As and when called, the petitioner shall join the investigation. He shall abide by the conditions enumerated under Section 438(2) of the Cr.P.C.

The petitioner shall remain bound by his undertaking to the effect that he shall pay an amount of Rs.1,00,000/- within a week and further amount of Rs.53,000/- within two weeks thereafter by way of demand draft to the complainant.
