Seeking cancellation of bail granted to the respondent vide order dated 15.12.2022, the State has come up before this Court under Section 439(2) r/w 482 CrPC.

The present petition was filed on 09.10.2023. The matter was got adjourned more than twelve times on one pretext or the other, mostly at the request of State counsel for seeking instructions, however on 04.07.2025, this Court had issued notice to the respondent.

As per report of Registry, State did not take steps for the service of the respondent and process fee was not filed. Moreover, concerned SHO/Investigator also not conveyed the order to the respondent.

Given above, the present petition is dismissed for non-prosecution. Liberty reserved to file fresh petition. It is clarified that dismissal of the present petition shall not come in the way and no adverse inference shall be drawn. All pending applications, if any, stand disposed of.
