Mr. Raj Kumar Bhatia, Advocate for the complainant/respondent No.2 along with complaint in person. ***** SANJIV BERRY. J. (Oral) By way of present petition filed under Section 438 of the Code of Criminal Procedure, 1973, petitioner seeks anticipatory bail in case FIR (Annexure P-1) as under:

Learned counsel for the petitioner submits that in terms of the previous order and settlement arrived at between the parties, the petitioner has brought two demand drafts of Rs.1 lakh bearing No.631711 dated 14.12.2023 and Rs.5 lakhs bearing No.631668 dated 19.10.2023, which are to be handed over to the complainant and undertakes to pay the balance amount of Rs.1 lakh (out of total amount of Rs.39 lakhs) on the next date of hearing fixed in CRM-M-604732023 filed for quashing of the FIR in question. Photocopies of the demand drafts have been placed on record. He submits that in compliance to the order dated 20.10.2023 passed by this Court, the petitioner has already joined the investigation SANDAL SHARMA 2023.12.18 10:15 I attest to the accuracy and authenticity of this order/judgment

Learned counsel for the complainant along with complainant in person have agreed to the submission made by learned counsel for the petitioner and have accepted the demand drafts amounting to Rs.1 lakh and Rs.5 lakhs today in the Court and have no objection in case the balance amount of Rs.1 lakh (out of total amount of Rs.39 lakhs) is paid on the next date of hearing fixed in CRM-M60473-2023 filed for seeking quashing of the FIR in question. Complainant has pleaded no objection in case the interim bail granted to the petitioner is confirmed. 4.

Learned State counsel, on instructions from ASI Gurmej Singh has intimated that the petitioner has joined investigation and is no more required for any custodial investigation in this case nor he is required for further investigation. 5.

Keeping in view the respective submissions and considering the documents on record and the fact that the petitioner had joined the investigation consequent to the order dated 20.10.2023 passed by this Court, interim bail granted vide order dated 20.10.2023 is hereby confirmed, subject to conditions as envisaged under Section 438(2) Cr.P.C. Further the petitioner is directed to join investigation as and when required in future by way of written notice for such purpose to be served by Investigating Officer of this case upon the petitioner; he will not tamper with the evidence nor will influence the witnesses and will not leave the country without prior permission of the Court. 7.

The petition stands allowed.
