**** JAGMOHAN BANSAL , J. (Oral) The petitioner through instant petition, is seeking quashing of FIR No. 135 dated 01.09.2018, under Section 498-A, 406, 506 and 120-B of Indian Penal Code, registered at Police Station Sadar Nabha, District Patiala and all consequential proceedings arising therefrom. Learned State counsel, on instructions from ASI Amarjeet Singh, states that challan stands presented against the petitioner. Charges stand framed and, at present, trial is fixed for prosecution witness. The next date before trial court is 16.03.2023. Thus, the present petition, in view of the aforesaid development, has become infructuous. On being confronted with aforesaid fact, learned counsel for the petitioners expressed his inability to controvert, however, prayed that the present petition may be allowed in view of its peculiar facts and circumstances.

I have heard the arguments of learned counsel for the parties and perused the record.

CRM-M-46547-2019 -2It is undisputed fact that the petitioner is assailing FIR whereas challan stands presented, charges stand framed and one prosecution witness has already been examined.

In view of these facts and circumstances, it would not be appropriate to quash the FIR. Accordingly, the petition is dismissed.
