Advocate for respondent No. 1. *** In the last order it is recorded that counsel for the parties were ad idem that the present appeal has been rendered infructuous in light of the fact that the parties have compromised the matter and statements in the execution proceedings have also been recorded. The counsel had sought some time to place on record the supporting documents.

Today, learned counsel for respondent No. 1 has placed on record copy of the order passed by Civil Judge, Junior Division, Sonipat dated 28.1.2019 dismissing the execution application, copy of order dated 12.2.2019 dismissing the objections filed by JDs, copy of statement of Rajesh stated to be defendant before the Court below along with copy of statement of Sandeep Malik, Advocate for decree holder with regard to the wall in question having been repaired and withdrawal of the execution application has been placed on record. Under the circumstances, the appeal is dismissed being infructuous. (H.S.
