Learned counsel for both the sides are ad idem that the impugned judgment dated 24.05.2017 of the Ist Appellate Court, be set aside, with a direction to it, to decide the appeal on merits within three months from today.

In view of the above, impugned judgment dated 24.05.2017 of the Ist Appellate Court, remanding the case to the trial Court for recording fresh evidence and decide the suit afresh, is set aside. The Appellate Court, is directed to decide the appeal on merits, on the basis of evidence already available on record, within three months.

Disposed of.

The parties are directed to appear before the Appellate Court on 23.07.2019.
