Present revision petition has been filed challenging the impugned order dated 30.08.2024 whereby the evidence of defendant No.2 i.e. petitioner herein was closed.

Learned counsel for the petitioner would contend that only the cross-examination of the petitioner remains and given one opportunity, he would present himself for cross-examination. It has further been contended that the petitioner is willing to compensate respondent No.1 by way of costs. 3.

Learned counsel appearing on behalf of respondent No.1 states that he has no objection if the present revision petition is allowed. 4.

In view of the above, present revision petition is allowed.
