NAMIT KUMAR J. (Oral) Prayer in this writ petition filed by the petitioner under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of certiorari, for quashing the impugned recovery notices/memos issued by the respondent - PSPCL including letter/memo No.4407 dated 19.07.2024 (Annexure P-2). Further a writ of mandamus has been sought for directing the respondents to immediately cease all recovery proceedings against the petitioner with respect to the alleged excess payment of Rs.2,60,050/- as demanded in the aforementioned recovery notices/memo (Annexure P-2). Further prayer has been made to direct the respondents to refund the entire amount already recovered/deducted from the petitioner's pension, which was made from her pension within a reasonable time period. CWP-25258-2024 Learned counsel for the respondents submits that the instant petition has been rendered infructuous, as the process for refunding the recovered amount of Rs.57,790/- is underway, and the said amount shall be refunded to the petitioner within a period of one month from today.
