On 03.10.2024 the following order was passed : Learned counsel for the petitioners would contend that while the mesne profits have been assessed, however, the application for stay has been dismissed rendering the appeal itself as infructuous.

Notice of motion returnable 05.02.2025.

Meanwhile, on depositing the mesne profits as assessed by the Appellate Authority, status quo shall be maintained.

Today, Mr. Tarun Jindal, Advocate has put in appearance on behalf of the respondent and filed his vakalatnama, which is taken on record. He states that he would have no objection if the present revision petition is allowed.

In view of the above, the present revision petition is allowed. Status quo qua possession shall be maintained till the decision of the appeal by the Appellate Authority. It is made clear that mesne profits as assessed by the Appellate Authority shall be deposited by the petitioner. 4.
