Despite the case having been called twice, the appellants have gone un-represented.
Learned counsel for the respondent submits that after remand of the case by the Ist Appellate Court, vide impugned judgment dated 23.08.2017, the trial Court has decided the suit afresh and the appellants have filed fresh appeal, therefore, the instant appeal has rendered infructuous.
In view of the above, the instant appeal is dismissed on two counts i.e. as having been rendered infructuous and for want of prosecution, as well.
